EB-5 IMMIGRATION PROCEDURES

Congress created the fifth employment-based preference (EB-5) immigrant visa category in 1990 for qualified foreigners seeking to invest in a business that will benefit the U.S. economy and create or save at least 10 full-time jobs.

1. U.S project/company gives EB-5 Investor Confidential Offering Memorandum describing EB-5 Investment Project

2. Investor signs Subscription Agreement and provides background information to U.S project/company.

3. Investor Deposits USD $500,000 into secure bank escrow account and pays U.S project/company subscription fee

4. Investor’s attorney submits I-526 application to USCIS

5. If Approved: Escrow account releases USD $500,000 to partnership account

If Declined: Escrow account returns investor 100% of USD $500,000

6. Investor has U.S. Consulate interview and is issued a conditional Green Card

7. Investor’s attorney submits I-829 application to USCIS for unconditional (permanent) Green Card (21-24 months after receiving conditional Green Card)

8. Conditional status of green card is removed and Green Card becomes permanent

9. After 5 years of issuance, investor is divested of EB-5 Investment Project (returned $500,000) and investor and family may apply for U.S. Citizenship
